POLICIES AND RULES

Gun Transfer Dealer Record Sale (DROS)

DROS (Dealer Record Sale)

All DROS have a mandatory 10-day waiting period (10 x 24 hour periods or 240 hours) unless you have a valid waiting period exemption.  We are not able to release your firearm until the full waiting period has passed.   If you go over 30 days, you will need to re-run DROS, pay an additional $25.00 and wait another 10 days. You will be provided with the earliest pick-up date upon completion of your DROS process.  In most circumstances we can release on the 10th day so long as we know what exact time to the minute that we DROSed the gun  All firearms must be picked up within 30 days of the initial DROS date.  If you fail to pick up your firearm within the 30 days, your DROS is automatically cancelled and you will have to re-start the DROS process.  Fees will apply if a re-DROS is required.

HIGH CAPACITY MAGAZINES

High capacity magazines can no longer be accepted and offered as rebuild parts kits due to California Law.  Magazines must be 10 round capacity.  PLEASE make sure that you tell your retailer not to send high capacity magazines because we are REQUIRED  to confiscate them.  Sorry everyone.

SPECIAL ORDERS

  1. Special orders on firearms that are not in stock must be pre-paid in full before an order can be placed.
  2. Once firearm(s) are ordered, ALL SALES ARE FINAL, REFUNDS, NO EXCEPTIONS unless:
  • The firearm is defective. Any defects must be discovered prior to the end of the transfer.  Once you take ownership of the firearm, only manufacturer warranties apply.
  • The distributor will take back the firearm.  Most cases, they will not.
       3.   A “Special Order Agreement” will be read, understood and signed.

STORAGE FEES AND ABANDONED FIREARMS

  • If you are not able to come in to start your DROS immediately, please just let us know as soon as possible when you think you will be able to come in. We generally give a two week grace period,but please remember that storage space is limited.
  • For guns that are received in error or guns that are not on the CA Approved Roster of Handguns, we charge a $50 minimum fee for return shipping and paperwork fees to return the gun to the seller.
  • Firearms received that have not begun DROS within 2 weeks of being received from their transferring FFL will incur a $50 storage fee for up to 30 days.
  • If the firearm is stored for longer than 30 days, it will incur an additional $50.
  • Firearms will be stored for up to 90 days at $50 per month. Firearms NOT claimed after 90 days will be considered ABANDONED and will become property of Ballistic Precision.
  • For person’s prohibited from owning firearms due to DROS being DENIED, we charge a minimum $50 fee for return shipping, and paperwork fees to return the gun to the seller.
  • If the firearm is purchased in store, we charge a 25% fee for restocking.
  • If after 90 days, you have not resolved any and all balances with Ballistic Precision, the firearm(s) or products will be considered ABANDONED and your Restocking Fee is NOT refundable.
  • If we notify you that a gun needs to be returned for any reason and you do not respond or refuse to pay the return fees, after 90 days the gun will be considered abandoned and will be sold to recoup fees or turned over to local law enforcement for destruction, at our discretion.

FIREARM SAFETY DEVICES

  • Effective January 1, 2002, the State of California requires that all firearms sold within the state, whether new or used, must be accompanied by a certified CA Department of Justice firearm safety device.  
  • Most manufacturers ship their guns with a lock, however not all are CA DOJ certified.  Most new guns come with a cable lock.  Locks are required for all guns, new or used, including lower receivers.
  • If you have an approved gun safe, you are exempt from the gun lock requirement for long guns only. You can fill out and sign a Safe Affidavit to include with your file to meet this requirement. You must know your gun safe make and model and safety features for the Safe Affidavit.

CALIFORNIA BOARD OF EQUALIZATION SALES TAX

  • If a firearm is coming in from outside of California, The California Board of Equalization (BOE), requires that Sales Tax must be collected on the entire purchase price, including shipping fees.
  • A detailed invoice must be provided at time of DROS so fees can be calculated accordingly.
  • If Sales tax has already been collected, then a detailed invoice is required, showing that Sales tax has indeed been collected by the seller.  The invoice must include the purchaser's name, firearm information (make, model serial #) and seller details.
  • If no invoice can be provided, CA Sales Tax will be based off of the “Fair Market Value” of the firearm, but we will still need a “Bill of Sale” stating the Seller’s information, Buyer’s information, firearm information and any additional information regarding the sale between both parties.
  • The transfer process cannot be finalized without the sales tax information on file.

Ballistic Precision is located in the San Tomas Business Center at 2060 Walsh Avenue, Suite 122, across from Nvidia and adjacent to the American Legion.  We are located inside Building One, which is directly to the left as you enter the complex.

Please call to set up an appointment.  It is ESSENTIAL that you call first for an appointment.  We strive to  give our undivided attention to one customer at a time.  At most we will allow two to three customers in our store at any given time. 

Also we are often required to leave the store to pick up orders, visit the gunsmith, or run various errands.  For your convenience, please call first before you drop by.  Thank You.
